TERMS & CONDITIONS OF ADMISSION

Track or Treat

The following are the terms and conditions of admission to Track or Treat (“The Festival”). In consideration for the opportunity to attend an event, and by entering the premises, each entrant agrees to such terms and conditions, which apply regardless of the form of any ticket or other invitation to an event, or where or by whom such ticket or invitation is held, stored, or displayed. Rules, instructions, and directions: The individual (“Attendee”) admitted to The Festival, and any minor(s) accompanying Attendee, must follow all rules of The Festival, and all posted and/or verbal directions and instructions of The Festival staff and volunteers, while present on The Festival premises. Failure to abide by such rules, instructions and directions may result in dismissal from the premises.

Prohibited items
No bags are permitted. Small purses/clutch-type handbags that are 4.5” x 6.5” or less in size are permitted (only one per person) and will be subject to screening prior to entering. You and your belongings may be searched on entry to the event. You consent to such searches and waive any related claims that may arise. If you elect not to consent to such searches, you may be denied entry to the event without refund or other compensation. Under certain facility rules, certain items may not be brought into the premises, including without limitation: firearms and drugs.The Festival is not responsible or liable for any unattended, lost or stolen items. Patrons agree to enter The Festival at their own risk and shall be responsible for their own property and personal items. Prohibited items will be confiscated and will not be returned, replaced or reimbursed.

Smoking
No smoking or vaping of any kind is permitted. Track Or Treat is a completely smoke-free event. The Festival site is an area of TOTAL FIRE BAN. Patrons may not use a flame including but not limited to camp fires, gas bottles, flares, sparklers, fireworks or fire twirling paraphernalia.

Food and Beverage
No outside food or drink permitted- Food, beverages, and adult refreshments will be available for purchase at the Festival. Purchasing alcohol for a minor is illegal

COVID-19
Attendee acknowledges that an inherent risk of exposure to COVID-19 exists in any public place where people are present. By visiting The Festival premises, Attendee voluntarily assumes all risks related to exposure to COVID-19. The Festival is required to follow Meadowlands Racing & Entertainment 2022 Covid Operational Plan.

Talent
Acts and/or Musicians may sometimes tour with headlining performers. We are not always made aware of the length of their performances. All Acts and/or Musicians, as well as Festival performers, are subject to change or cancellation at any time without notice.

Sale
The sale or attempted re-sale of a ticket by the Ticket Holder (including via online auction sites, unauthorized ticket resellers or ticket scalpers) is prohibited. If a ticket is sold or used in breach of these Event Terms, the Organizer retains the right to: cancel the ticket without a refund, refuse entry to or eject the Ticket Holder from the Event and/or commence legal proceedings. Should the Organizer offer a resale facility this will be the only legitimate way to on-sell any unwanted tickets. Use of tickets for or in conjunction with any advertising, promotion, marketing or competition is strictly prohibited.

Trademark
The Event name (and variations) is a registered trademark of Track or Treat and protected by law. The name, logo, images, tickets or other works and materials associated with the Festival cannot be used in any way (including promotions, advertising and ticket giveaways or for any commercial purpose) unless authorized by the Organizer in writing

Refunds
No refunds for Track Or Treat tickets will be issued at any time. All ticket sales are final and there is no re-entry permitted. No change to your arrival day and time is permitted after your purchase has been made and your ticket is confirmed. All ticket sales are final. If you would like to make a request for a change, please contact our service team at info@trackortreatnj.com. We cannot guarantee your request for a change will be granted. There will be no refund of any unused portion of a ticket if you are asked or forced to leave the Festival for any of the reasons set out in the Festival Terms or if you decide not to attend. We will not be liable for travel or any other expenses that you or anyone else incur in connection with a canceled, postponed, rescheduled, or moved event.

Venue
Please note that the venue map is representative of the layout; however, it is subject to change at any time, and refunds are not allowed if the venue map is updated. Strobe lights are used throughout The Festival. Please consult with your doctor before coming. Patrons must not cause damage to, improperly use or tamper with any public facility or The Festival infrastructure or cause any damage to flora and fauna on or surrounding The Festival venue or enter any onsite bodies of water. Patrons must not remove or attempt to remove any item or object from The Festival venue or surrounding area. Patrons accept full liability and responsibility for any loss or damage caused in contravention of this clause or these Festival Terms. The Festival event times are subject to change. If The Festival is canceled

Force Majeure
Track or Treat (“The Festival”) will not be liable for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes (which causes are hereinafter referred to as “Force Majeure”), to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic (including the Covid-19 pandemic), quarantine, civil commotion, breakdown of communication facilities, breakdown of web host, breakdown of internet service provider, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, or generalized lack of availability of raw materials or energy. Client agrees to take out adequate travel and cancellation insurance against all relevant risks and contingencies at their own expense. Weather
The Festival is a rain or shine event. Please come prepared. Lighting storms may be unsafe for performers, staff, volunteers, and ticket holders to enter or remain in the venue. If an event must be canceled for safety reasons, after the doors open, refunds will not be given. In the event the Festival needs to cancel due to extreme weather, a rain date may be scheduled. Please contact our service team at info@trackortreatnj.com for more information should there be a cancellation due to extreme weather.

Dogs
Service dogs are permitted. Non-service dogs or any other pet is prohibited from entering The Festival.

Costumes
Costumes are welcome, but no masks other than protective COVID-19 masks are permitted.

Merchandise
All merchandise purchases are final, and in no event will there be refunds, exchanges, or credits for merchandise purchases.

Waiver and release of liability; indemnification
In exchange for admission to The Festival premises, Attendee hereby releases, discharges, and agrees to hold harmless The Festival, the City of Sandpoint, and their respective affiliates, and their respective directors, officers, volunteers, employees, agents, contractors and representatives; other Festival attendees; event performers/performer; Festival sponsors, advertisers and vendors; and the successor and assigns of each of them (each considered one of the “Releasees” herein), to the fullest extent permitted by law, from any and all liability, claims, demands, losses, and damages, which Attendee and/or any minor accompanying Attendee has or may have for any claims or causes of action arising out of or relating in any manner to attendance at The Festival premises; attendance at, observation of and/or participation in any event at The Festival premises; or any related activities. In further exchange for admission to The Festival premises, Attendee agrees to indemnify, defend and hold harmless any and all Releasees from and against any and all demands, suits, claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees and expenses), including but not limited to, any claims by or on behalf of Attendee or any accompanying minor, arising out of or relating in any manner to (i) Attendee’s and/or an accompanying minor’s attendance at The Festival premises; attendance at, observation of, and/or participation in any event at The Festival premises; or any related activities, or (ii) Attendee’s and/or an accompanying minor’s acts or omissions. In exchange for admission to The Festival premises, Attendee covenants not to sue (or assist any person in suing) any Releasee for any matter related to the above assumptions, releases, indemnifications, or agreements.

IMPORTANT PLEASE READ: You must agree to all of the Terms and Conditions to purchase tickets. We reserve the right to modify or amend these Terms from time to time with or without prior notice. You should review these Terms from time to time to be aware of any changes that are made

The Festival reserves the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct management deems disorderly, who uses vulgar or abusive language or who fails to comply with The Festival rules. Breach of terms or rules will terminate your license to attend the event without refund. A ticket is a revocable license and admission may be refused upon refunding the ticket’s face amount. A ticket is not redeemable for cash.
